Povinnost starat se o pozemek
Dlouhou dobu jsem se pídil po tom, zda jsou majitelé pozemků povinni se o ně starat, nebo zda je mohou nechat jen tak ležet ladem. A už jsem našel.
Povinnost se o pozemek starat vyplývá ze zákona o rostlinolékařské péči. Ten zpravidla konkretizuje závazná vyhláška obce. Jde tedy o zákonnou povinnost, kterou kontroluje příslušný odbor životního prostředí na obci. Ten zpravidla vyzve majitele pozemku k nápravě, k čemuž mu poskytne lhůtu. Po uplynutí této lhůty ukládá pokuty. Některé obce po neuposlechnutí výzvy samy trávu posekají a zašlou fakturu vlastníkovi. To už je ale na praxi jednotlivých obcí. Vaši prosbu tedy adresujte na obci odboru životního prostředí. Pokud byste se nedočkali nápravy, můžete podat stížnost na obec krajskému úřadu.

Tedy zákon o rostlinolékařské péči 326 z roku 2004 říká:
§ 3 Základní povinnosti fyzických a právnických osob
(1) Fyzická nebo právnická osoba, která pěstuje, vyrábí, zpracovává anebo uvádí na trh rostliny, rostlinné produkty nebo jiné předměty, a vlastník pozemku nebo objektu nebo osoba, která je užívá z jiného právního důvodu, jsou povinni
a) zjišťovat a omezovat výskyt a šíření škodlivých organismů včetně plevelů tak, aby nevznikla škoda jiným osobám nebo nedošlo k poškození životního prostředí anebo k ohrožení zdraví lidí nebo zvířat,
§ 78 Pokuty
2) Fyzické osobě, která se dopustí přestupku tím, že
a) nezjišťuje anebo neomezuje výskyt a šíření škodlivých organismů tak, aby nevznikla škoda jiným osobám nebo nedošlo k poškození životního prostředí a nebo k poškození zdraví lidí nebo zvířat podle § 3 odst. 1 písm. a) při výskytu škodlivého organismu včetně plevelů,
lze uložit pokutu do výše 30 000 Kč.
